HOA elections seek to give every qualified member a voice and a chance to lead the HOA and it’s important for these ceremonies to done lawfully. Not following your own rules.
As we mentioned in our previous post, the HOA rules and regulations are in place for a reason. Not following your own rules can lead to a variety of issues. They should lay out when the election will be announced, how it will be decided, who will oversee the process, and how a win will be determined.
Not providing enough proxies.
Without enough people in attendance and proxies, the election meeting will not be allowed to move forward. Therefore, have proxies signed in advance to prevent HOA members from having to knock on neighbors doors and request last minute attendance.
Forgetting the check the quorum.
The quorum, or number of assembly members needed to be present to make the election valid, is a governing rule that many HOA’s fail to consider prior to an election. Ensure enough members are present to validate the election and make it legal.
Letting anyone and everyone vote.
“Keep a roster of who can vote,” says Matthew A. Drewes, a partner at Thomsen & Nybeck PA in Edina, Minn., who represents associations. “The number of votes per unit should be based on the owners of that unit nominating someone to cast a vote on their behalf. So if a couple lives in a unit, they don’t get two votes.” Keep a tally of how many people per household vote so that they don’t exceed their allotted votes.
